Voice & Telephony Service Schedule — Australia (Schedule A)

This Schedule forms part of the Zivah AI Terms & Conditions of Trade and applies to customers in Australia. It sets out the telephony, numbering and emergency-calling terms for the Service. Capitalised terms have the meaning given in the Terms.
A1. Carriage and our role
A1.1 The telephone origination, termination and numbering used by the Service (the "Carriage Services") are supplied by a licensed Australian carriage service provider ("Carriage Provider") under the Telecommunications Act 1997 (Cth).
A1.2 Zivah is not a carrier and is not a carriage service provider. We provide the AI voice agent application that operates over the Carriage Services. References to "we" providing telephony features mean we arrange them through the Carriage Provider.
A2. Telephone numbers — allocation and rights of use
A2.1 Telephone numbers used with the Service are allocated and managed under the Telecommunications Numbering Plan 2015. A number provided to you is licensed for your use while you subscribe; you do not own the number.
A2.2 We will tell you the number(s) assigned to your Service and use them as the caller identification for calls your agent makes, unless you lawfully request a different number you are entitled to use (see A6).
A3. Bringing a number in (port-in) and taking a number out (port-out)
A3.1 Port-in. You may ask us to port an existing eligible Australian number into the Service. We (through the Carriage Provider) will use reasonable efforts to complete the port, subject to the losing provider's processes and the number being eligible. You confirm you are authorised to port the number.
A3.2 Port-out. You have the right to port an eligible number out of the Service to another provider. We will not unreasonably withhold or delay a port-out and will facilitate it in accordance with industry porting processes. Outstanding fees may still be payable, but we will not use them to block a port-out where the law requires us to facilitate it.
A3.3 Porting may involve a brief interruption to the Service for the affected number.
A4. Emergency calls (000) — important
A4.1 The Service is not a replacement for a standard telephone service and must not be relied on to make emergency calls. The Service may not be able to reach the emergency call service (000), and even where a call connects, location information may not be available to the emergency operator.
A4.2 You must ensure that you and anyone relying on a number operated through the Service has an alternative means of calling 000 (for example a mobile phone or a standard telephone line).
A4.3 You must make this limitation clear to your own staff and to anyone who may use a number operated through the Service.
A5. Caller identification (CLI)
A5.1 Calls made by your agent will present a truthful caller identification — a number you are entitled to use. We do not support presenting misleading or "spoofed" caller identification, and you must not request it. Misuse of caller identification may breach the Telecommunications Act 1997 (Cth).
A6. Call transfer and routing to your own systems
A6.1 Transfer to third parties. Your agent can be configured to transfer live calls to third parties (for example, to you, your staff, or another business). You are responsible for the configuration and for the call once it is transferred. Charges may apply to transferred call legs as published.
A6.2 Routing to your own PBX / SIP. Where supported, you may route a number operated through the Service to your own IP-PBX or SIP trunk. If you do, you are responsible for your own equipment, configuration and the carriage beyond the handoff point, and the Service's responsibility ends at the agreed handoff.
A7. Acceptable use of telephony
Your use of the telephony features is subject to the Acceptable Use Policy, including the rules on outbound calling, the Do Not Call Register, the Spam Act, the Telemarketing Industry Standard, and caller identification.
A8. On termination
On cancellation or termination of the Service, numbers hosted on the Service will cease to operate unless you have ported them out (see A3.2). We will give you a reasonable opportunity to arrange a port-out before a number is reclaimed.
