Zivah AI — Acceptable Use Policy

This Acceptable Use Policy ("AUP") forms part of the Zivah AI Terms & Conditions of Trade. It sets out how you may and may not use the Service. If you breach this AUP we may suspend or terminate your Service (see the Terms).
1. General
You must use the Service lawfully and must not use it to break any law, infringe anyone's rights, or harm others or our network and reputation.
2. Outbound calling and telemarketing
If you use the Service to make outbound calls, you are responsible for complying with Australian law, including:
- Do Not Call Register Act 2006. You must not make telemarketing calls to numbers on the Do Not Call Register unless an exemption applies. Note that business landlines cannot be registered on the Register, but mobile numbers can be (including those used by sole traders), so those lists must be "washed" against the Register where required.
- Telemarketing and Research Industry Standard 2017. You must observe permitted calling hours, present truthful caller identification, identify your business at the start of the call, and honour opt-out / do-not-call requests promptly. These rules apply to all telemarketing calls regardless of how you sourced the list.
- Spam Act 2003. If you use the Service (or related messaging) to send marketing emails or SMS, you must have consent (or an applicable exemption), identify yourself, and include a working unsubscribe facility. The Spam Act applies to business-to-business messages too.
3. Caller identification
You must not configure your agent to present misleading or falsified caller identification. The caller ID presented must be a number you are entitled to use (see the Voice & Telephony Service Schedule).
4. Call recording and notice
Where calls are recorded, you are responsible for ensuring callers are appropriately notified, in accordance with the Telecommunications (Interception and Access) Act 1979 (Cth) and applicable state law (in Queensland, the Invasion of Privacy Act 1971 (Qld)).
5. Prohibited uses
You must not use the Service to:
- make unlawful, fraudulent, harassing, threatening, deceptive or scam calls;
- impersonate another person or business, or mislead callers about who they are dealing with;
- handle calls for unlawful goods or services, or content that is illegal, abusive or infringing;
- attempt to use the Service as an emergency-calling service (see Schedule A4);
- interfere with, overload, or attempt to gain unauthorised access to the Service or network;
- resell or expose the Service to third parties except as permitted in writing.
6. Transfers to third parties
If your agent transfers calls to third parties, you are responsible for those arrangements and for ensuring the transfer and any onward handling comply with this AUP and the law.
7. Consequences
If you breach this AUP, we may give you notice to fix the breach, suspend the Service, or — for serious or repeated breaches, or where required by law or to prevent harm — terminate the Service. We may also be required to act on directions from regulators (such as ACMA or the OAIC).
